Fujimori to be tried for the alleged US $15 million payment to advisor Vladimiro Montesinos in the year 2000
Court will be formed by judges César San Martín, Víctor Prado and Sócrates Zevallos
The Supreme Court’s Special Criminal Court has recently announced that the new trial against the former Peruvian president will begin on July 13 for having allegedly ordered US$15 million to be paid to his former intelligence advisor, Vladimiro Montesinos in the year 2000. Only three months ago, Alberto Fujimori was condemned to a 25-year prison sentence in his latest trial for human rights violations.
In the case of the $15 million, the Supreme Public Prosecutor accuses Fujimori of embezzlement of public funds and moral turpitude for having used government finances for personal purposes. Public Prosecutor José Peláez has requested an eight-year sentence and the payment of a civil reparation of two million Peruvian new soles (nearly US $670,000).

Será juzgado por haber ordenado la entrega de US$ 15 millones a Vladimiro Montesinos el año 2000
Tribunal esta conformado por los vocales César San Martín, Víctor Prado y Sócrates Zevallos
Luego de tres meses de culminado el proceso penal a Alberto Fujimori por violaciones de los derechos humanos, donde fue condenado a 25 años de prisión, la Sala Penal Especial de la Corte Suprema anunció que el 13 de julio iniciará el nuevo juzgamiento al ex gobernante peruano por haber ordenado el año 2000 la entrega de US$ 15 millones a su ex asesor de inteligencia, Vladimiro Montesinos.
En este caso la Fiscalía Suprema acusa a Fujimori por los delitos de peculado y falsedad ideológica por haber utilizado dinero del Estado Peruano para propósitos particulares y, por eso, el fiscal José Peláez pidió que se le condene a ocho años de prisión y pague una reparación civil de dos millones de soles.
Mientras tanto, César Nakazaki, abogado del inculpado, adelantó que su defensa legal estará centrada en demostrar que su patrocinado no cometió ningún delito porque el dinero que se le entregó a Montesinos fue devuelto al Estado y que, por lo tanto, éste no se vio afectado de ningún modo.
Según el ordenamiento legal peruano, las condenas contra un procesado no pueden ser acumuladas. Eso significa que la pena de 25 años contra Fujimori -que se encuentra bajo revisión en un Tribunal Supremo debido a que su defensa pidió que se anule-, no podría ser acumulada si es que nuevamente es condenado.

Fujimori’s new trial will begin in three weeks
The Court denied Nakazaki’s request to remove two justices
On June 23rd , the Supreme Court’s First Transient Criminal Court denied Alberto Fujimori’s defense attorney’s request to remove justices César San Martín y Víctor Prado from the court that will be hearing his new criminal trial for illegally giving $15 million to Vladimiro Montesinos in 2000.
Through this denial, the Supreme Court diminishes the argument made by César Nakazaki that the two judges cannot try Fujimori because they demonstrated biased conduct in Fujimori’s previous trial for violations of human rights. In that trial the justices condemned Fujimori to 25 years in prison for human rights violations.

La Primera Sala Penal Transitoria de la Corte Suprema resolvió este martes 23 rechazar el pedido de la defensa de Alberto Fujimori para apartar a los vocales César San Martín y Víctor Prado del tribunal que se encargará de su nuevo proceso penal por la entrega ilegal de US$ 15 millones a Vladimiro Montesinos el año 2000.

Justices have 15 Days to Resolve the Recusal of the Members of the Special Criminal Court
Justice Hugo Príncipe will not join the group that will try the ex-president
César Nakasaki, Alberto Fujimori’s attorney, argued that justices César San Martín y Víctor Prado are biased against Fujimori this Wednesday in a public hearing in the Supreme Court’s Transient Criminal Court. He argued that because of this bias, they should not be part of the court that will soon be starting a new criminal proceeding against the ex-president for giving $15 million to Vlaimiro Montesinos in 2000.
Nakasaki reiterated that he was recusing these justices because they have shown that they are only interested in looking for a legal way in which to condemn Fujimori and they will not perform their job as impartial arbitrators. This is the same argument that Nakasaki used three weeks ago before another court that reviewed the first recusal against San Martin, Prado y Hugo Príncipe. During this prior recusal, the court ruled in favor of Nakasaki and consequently Príncipe was removed from Fujimori’s trial. Nevertheless, not satisfied with this judicial decision, Nakasaki appealed and therefore the Transient Criminal Court will decide whether San Martin and Prado will follow in Príncipe’s footsteps. Magistrados tienen 15 días para resolver recusación contra miembros de Sala Penal Especial
Vocal Hugo Príncipe no integrará colegiado que juzgará a ex presidente
César Nakazaki, abogado de Alberto Fujimori, expuso este miércoles en una audiencia pública en la Sala Penal Transitoria de la Corte Suprema que los vocales César San Martín y Víctor Prado están parcializados en contra de su patrocinado y, por ese motivo, considera que no deben integrar el tribunal que pronto iniciará el nuevo proceso penal al ex presidente por la entrega de US$ 15 millones a Vladimiro Montesinos el año 2000.
El abogado reiteró que recusó a estos magistrados porque han dado muestras de que solo les interesa buscar la forma legal de condenar a Fujimori y no realizan su función de árbitros imparciales. Ese es el mismo argumento que utilizó el letrado hace tres semanas ante otro tribunal que revisó su primera recusación contra San Martin, Prado y Hugo Príncipe. [Read more →]
